Terms of service

You need to be old enough to enter a contract where you live, and at least 13. If you are acting for an organisation, you confirm you may bind it.

Answering someone's poll needs no account. Making one does, and you are responsible for what happens under it — keep your sign-in to yourself.

The questions you write and the answers you collect belong to you. You give us only the permission needed to run the service: to store what you make, show it to the people you share the link with, and put the results on a map.

MappBook itself — the software, the maps, the name and the marks — stays ours.

The only things an audience can contribute are presence and a choice from a list you wrote, plus any text you explicitly ask for. That makes the list below short, and it is mostly about what a creator writes. You may not use MappBook to:

• Deceive people, including phishing, impersonating somebody, or presenting a poll as being run by a person or organisation that is not running it.
• Promote pyramid or multi-level marketing schemes, high-yield investment programmes, or anything else that misleads people about money.
• Direct people to malicious or deceptive destinations.
• Harass, threaten, or attack people — including on the basis of race, ethnicity, religion, disability, sex, gender, or sexual orientation.
• Break the law where you or your audience are, or ask questions designed to extract information you have no right to.
• Collect personal information from people without telling them why, or ask a child for it.
• Send unsolicited bulk messages, or use the service to generate them.
• Interfere with the service: probing it, scraping it, overloading it, or working around the limits it puts on answering.
• Fake results, whether by scripting answers, using multiple devices to vote repeatedly, or paying other people to.

We may remove a link and suspend or close an account that breaks these terms, without notice where the harm is immediate. Where it is not, we will tell you first.

If you ask your audience for written answers or an email address, you decide what is collected and why — so telling them, and having a lawful basis for it, is your job. Our Data Processing Agreement sets out what we do with it on your behalf.

A map here shows how the people who answered a particular link answered it. It is not a survey of a country, it is not weighted, and the people who answer are the people who saw the link — not a representative sample of anywhere.

Country is derived from the network a request arrives on, which can be disguised. Please do not present these results as something they are not.

We will try to keep the service running and will not always succeed. It is provided as it is, without warranty of any kind. We may change or discontinue features, and where a change would lose you data we will give reasonable notice first.

To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, or for lost profits or lost data. Our total liability for any claim is limited to what you paid us in the twelve months before it arose, or NZ$100 if that is greater.

Nothing here limits rights that cannot be limited — including, for consumers in New Zealand, rights under the Consumer Guarantees Act 1993.

You can close your account at any time. We can end this agreement if you break these terms. When it ends, your links stop working; what they collected is handled as the privacy policy describes.

New Zealand law governs these terms and its courts have jurisdiction, without affecting consumer rights you have where you live.

If we change them materially we will change the date at the top and, for account holders, say so before the change takes effect. Questions go to contact@mappbook.com.
